General Terms of Use
The present terms of use (hereinafter the “Terms of Use”) govern the relationship between PRALOGNAN – DOMAINES de MONTAGNE (hereinafter “PDM”), which operates ski lifts in the Pralognan-la-Vanoise mountain area, and any person (hereinafter the “User”) who:
Uses a transport ticket (hereinafter a “Transport Ticket”) allowing access to one or more ski lifts operated by PDM; or
Takes part in an activity (hereinafter an “Activity”) marketed by PDM.
By using a Transport Ticket or by taking part in an Activity, the User unreservedly accepts the Terms of Use.

ARTICLE 2. ACCESS TO SKI LIFTS
Transport Tickets grant access to the ski lifts operated by PDM and, for some of them, to the lifts of the “Vallée de Courchevel” area.
However, certain ski lifts may be closed, with or without notice, in particular for weather-related or health reasons. PDM does not guarantee the daily opening of all the ski lifts it operates.
Access restrictions, linked for example to the User’s age, physical condition, or the equipment used (skis, snowboard, MTB, etc.), may apply to certain ski lifts. These restrictions can be consulted at PDM's points of sale and at the boarding point of each ski lift. It is the User’s responsibility to ensure that they are not subject to an access restriction. Any User subject to a restriction will be refused access to the ski lift concerned, without the User or the person who purchased the Transport Ticket used by that User being entitled to any compensation whatsoever.
Access to ski lifts with a “pedestrian” Transport Ticket is only permitted if the User is not carrying any transport equipment (skis, snowboard, MTB, sled, scooter, etc.), even if held in the hand. Pedestrians may be accompanied by their pet on the cable car provided that it is kept on a leash by its owner, who may under no circumstances leave it alone on the site and subject to the restrictions mentioned at the entrance to the cable car.
Access to a ski lift with an MTB is only permitted if the following conditions are met:
MTBs appear on the list of vehicles authorized by the police regulations displayed at the departure of the ski lift;
The User holds a Transport Ticket allowing access to the ski lifts with an MTB.
Transport Tickets issued for the winter season do not allow the use of ski lifts operated by PDM with an MTB.
MTB riding is prohibited in winter on ski slopes accessible via the ski lifts.
“Pedestrian” Transport Tickets issued for the summer season do not allow the use of ski lifts operated by PDM with an MTB.
Transport Tickets do not confer any priority access to any ski lift. Holders of a Mobility Inclusion card (marked “priority”) or a professional ski instructor card do, however, benefit from priority access to the ski lifts.
To facilitate the transmission of permissions when the User passes through the access gates to the ski lifts, the Transport Ticket must be placed in a left-side pocket containing nothing other than the Transport Ticket.
Non-emancipated minor Users must be constantly accompanied by an adult, who must supervise them in all circumstances.
ARTICLE 3. PARTICIPATION IN ACTIVITIES
Access restrictions, linked for example to the User’s age or physical condition, may apply to certain Activities (cross-country skiing and other event activities offered by PDM such as, for example: astronomy evenings …). These restrictions can be consulted at PDM's points of sale and on the Website. It is the User’s responsibility to ensure that they are not subject to an access restriction. Any User subject to a restriction will be refused access to the Activity concerned, without the User or the person who booked the Activity for that User being entitled to any compensation whatsoever.
Non-emancipated minor Users must be constantly accompanied by an adult, who must supervise them in all circumstances.
ARTICLE 4. COMPLIANCE WITH RULES
The User must comply with the police regulations displayed at the departure of the ski lifts operated by PDM, as well as with the instructions given by any member of PDM staff when using these ski lifts. The User is also advised to follow the “ten rules of good conduct for slope users” published by the International Ski Federation.
The User must comply with health rules enacted by the public authorities or by PDM pursuant to a decision of the public authorities. If a health protocol applies, it is displayed at PDM's points of sale and on the Website.
The User must refrain from any behavior that harms or may harm the safety, health, and tranquility of other users, PDM staff, and PDM's subcontractors (state of inebriation, verbal or physical violence, consumption of tobacco, alcohol or drugs, vaping, carrying weapons, shouting, use of devices producing excessive noise, pushing, cutting in access lines, etc.) in the departure and arrival areas of the ski lifts operated by PDM, as well as on these ski lifts. The User must also refrain from damaging the equipment operated by PDM.
Failing this, PDM reserves the right to prohibit the User from accessing the ski lifts it operates, to inform any territorially competent law enforcement officer, and to initiate any proceedings against the User.
ARTICLE 5. CHECKS
A “hands-free” gate system enables automatic control of access to the ski lifts operated by PDM.
The User must be able to present to PDM staff or to any sworn inspector:
An original, valid Transport Ticket allowing access to the ski lift used, in their own name if it is a nominative Transport Ticket;
Proof of booking for an Activity;
Where applicable, the original document(s) proving that they meet the conditions to benefit from a reduced-price or free Transport Ticket or Activity.
Failing presentation of the documents listed above, the User cannot access the ski lift or the Activity and must pay the price of the Transport Ticket necessary to access the ski lift and/or the price of the Activity.
In the event of a check and a recorded offense by a sworn inspector, if the User is 13 years old or over, they must also pay a fixed indemnity equal to five times the value of the one-day Transport Ticket allowing access to the ski lift the User attempted to use or used, or the amount of the Activity. If the User is under 65, the fixed indemnity is calculated on the basis of a Transport Ticket/the amount of the Activity at the “adult” rate. If the User is 65 or over and under 75, the fixed indemnity is calculated on the basis of a Transport Ticket/the amount of the Activity at the “senior” rate. The amount of this fixed indemnity is rounded up to the next euro.
If the User cannot or does not wish to pay the amount of the fixed indemnity immediately, the sworn inspector draws up an infringement report. The inspector is then authorized to record the User’s identity and address. If the User refuses or is unable to prove their identity, the sworn inspector immediately reports this to any territorially competent law enforcement officer, who may order them to bring the User before them immediately. This procedure ends immediately if the User pays all sums due under the settlement. The User has a period of three months from the recording of the offense to pay the amount of the settlement, including any amount corresponding to the price of the Transport Ticket, the fixed indemnity and the file administration fees. The User may also, within the same period, send a reasoned objection to PDM. If payment is not made within the aforementioned period and in the absence of an objection, the infringement report is sent by PDM to the public prosecutor and the User becomes automatically liable for an increased fixed fine collected by the Public Treasury.
The User may have withdrawn by a sworn inspector the Transport Ticket of a third party that they are using, so that it can be returned to its rightful holder.
ARTICLE 6. NON-TRANSFERABILITY OF TRANSPORT TICKETS AND ACCESS TICKETS FOR ACTIVITIES
Transport Tickets and access tickets for Activities are personal and may not be transferred, whether for consideration or free of charge, to any third party. Any Transport Ticket or access ticket for an Activity that has been transferred in this way is considered invalid.
By way of exception, the non-nominative Transport Ticket of the shortest duration and purchased at the highest price is transferable. However, the new holder of the Transport Ticket must meet the conditions set by PDM (notably age) to benefit from this Transport Ticket.
ARTICLE 7. LOSS OR THEFT OF A TRANSPORT TICKET OR AN ACCESS TICKET FOR AN ACTIVITY
In the event of loss or theft of the chip card to which the Transport Ticket or the access ticket for an Activity is linked, or of the QR code constituting the access ticket for an Activity, the User must report this loss or theft at a PDM point of sale if this Transport Ticket or access ticket was purchased from PDM or one of its distributors. They must then provide:
If the Transport Ticket or access ticket for the Activity was purchased from PDM, the original order receipt for the Transport Ticket or access ticket for the Activity;
If the Transport Ticket or access ticket for the Activity was purchased from a PDM distributor, the UID number of the chip card to which the Transport Ticket or access ticket for the Activity was linked.
Upon presentation of these items, a new chip card or a new QR code is issued immediately. Issuing a new chip card is charged to the User at the rate displayed at the points of sale. This amount is non-refundable if the chip card is found. Issuing a new QR code is free of charge. The new chip card or the new QR code allows the User to benefit from a new Transport Ticket or a new access ticket for the Activity for the residual duration of the initial Transport Ticket or access ticket for the Activity.
Permissions on lost or stolen chip cards or QR codes are immediately deactivated. They can therefore no longer be used, even if the chip cards or QR codes are found.
With regard to Transport Tickets that give rise to the invoicing of days skied, these days are invoiced to the purchaser of the Transport Ticket until the loss or theft of the Transport Ticket is reported, whether the Transport Ticket is used by its legitimate holder or by a third party.
By way of exception, access tickets for an Activity that have been fully used cannot be replaced, even if used by someone other than the legitimate holder.
If the Transport Ticket or access ticket for the Activity was purchased from an entity other than PDM or one of its distributors, the User must report the loss or theft of this Transport Ticket or access ticket for the Activity to that entity.
ARTICLE 8. DEFECTIVE CHIP CARD
Chip cards to which a Transport Ticket or an access ticket for an Activity is linked must not be bent, pierced, broken, or placed near a heat source.
In the event of a chip card malfunction, the User may hand it in at one of PDM's points of sale. A new card will be provided free of charge. However, if it appears that the malfunction is due to the User’s failure to comply with the Terms of Use, the replacement of the card will be charged to the User at the rate displayed at the points of sale.
If the chip card was provided by an entity other than PDM, the User must contact that entity to obtain a replacement.
ARTICLE 9. PHOTOGRAPHY ON THE SKI AREA
During the winter season, users are automatically photographed during their journey on the Mont Bochor cable car.
Users can obtain their photograph free of charge on the “Pralognan” mobile app. To do so, they must:
Download this app to their mobile phone;
Create a personal account on this app;
Register their valid Transport Ticket in their personal account;
Select their photograph on the screen of the terminal provided for this purpose;
Tap their Transport Ticket on the terminal.
If this procedure is not followed, PDM will be unable to respond favorably to Users’ requests to obtain their photograph.

If the User has suffered damage while using ski lifts operated by an operator other than PDM, they must address their complaint to that other operator.
ARTICLE 12. DISPUTE RESOLUTION
In the event of a dispute between the User and PDM relating to the validity, interpretation or performance of the Terms of Use, the User may use, free of charge, a conventional mediation procedure or any other alternative dispute resolution method.
They may resort to mediation with the Médiateur du Tourisme et du Voyage (MTV – Médiation Tourisme Voyage, Service dépôt des saisines, CS 30958, 75383 Paris cedex 08, France – Tel.: +33 (0)1 42 67 96 68 – Email: info@mtv.travel) under the conditions set out on the website https://www.mtv.travel and within a maximum period of one year from the written complaint submitted to PDM.
Failing amicable settlement, the User may bring the matter before either one of the courts territorially competent under the French Code of Civil Procedure, or the court of the place where they resided at the time of the conclusion of the contract or the occurrence of the harmful event.
ARTICLE 13. GREENHOUSE GAS EMISSIONS
